SACRAMENTO, CA — A Biden-appointed federal judge has refused Steve Hilton’s request to expedite the hearing for his lawsuit challenging Gavin Newsom’s unconstitutional election-rigging scheme, Proposition 50, instead scheduling the hearing for November 6, two days after the election.

Hilton’s lawsuit argues that Proposition 50, Governor Gavin Newsom’s attempt to let Sacramento politicians redraw California’s congressional districts years before the next census, violates the Equal Protection Clause, which clearly establishes that the principle of one person one vote, where every vote has equal value, requires that electoral districts be roughly equal in population size. Obviously, that constitutional test has not and cannot be met in this case. Millions of Californians have fled the state since the last census.

Entire neighborhoods have burned to the ground. Without an up-to-date census, it is impossible to ensure Prop 50’s gerrymandered districts are of roughly equal population size.

“Gavin Newsom knows his election-rigging scheme is unconstitutional. That’s why, from the moment we filed our lawsuit, he played for time. It is outrageous that this Biden judge has now aided and abetted this unconstitutional scheme to boost Newsom’s presidential ambitions by disenfranchising millions of Californians.” Hilton said. “Worse still, this Biden judge is denying our application because we followed the law! We filed our lawsuit on September 4th. We followed the normal legal procedures. Gavin Newsom did not. As a result, a month passed, at which point we applied to expedite the process. The judge is attacking me for “delay”, falsely claiming that “Plaintiff is at fault for creating the purported crisis that requires ex parte relief”, when it is Gavin Newsom who delayed this legal proceeding.”

“Newsom rammed this through his puppet legislature. Then his puppet courts. This is the kind of thing you see from authoritarian regimes and corrupt dictatorships. We know Prop 50 is unconstitutional. We will not drop this case, even if Gavin Newsom, backed by union and George Soros cash, somehow manages to win this illegitimate vote. In the meantime: Vote no on Prop 50!”
