SACRAMENTO, CA — Governor Gavin Newsom admitted the truth months ago: allowing biological males to compete in girls’ sports is “deeply unfair.” And then, just like with homelessness, crime, and failing schools, he did nothing. Under California’s AB 1266, biological males can legally compete against girls, take their scholarships, and enter their locker rooms.

Newsom has the power to stop it. He refuses to act. Steve Hilton won’t.

On Saturday, May 31, Hilton announced his plan to solve the absurdity of biological males competing in girls’ sports. Joining him were Clovis Mayor Pro Tem Diane Pearce and Sophia Lorey, Outreach Director for the California Family Council and a former college athlete.

“It is AB 1266, enacted in 2013, that enables this madness. It actually violates California’s state constitution, yet where is Gavin Newsom? What is he doing? Nothing and nowhere,” Hilton said. “That will change when I am elected governor. On day one, I will demand that the legislature repeal this cruel, unfair, dangerous law. If they refuse, I will sue, and we will win. But one way or another, this cruelty, this absurdity, this unfairness to our girls here in California and their right to pursue their dreams in sport and in every other way, one way or another, this absurdity, this cruelty, this unfairness, will end when I am governor of California.”

On day one as governor, Steve Hilton will demand the repeal of AB 1266. If the Legislature refuses, he will file suit to invalidate this law because it is unconstitutional. It violates the right to a safe school environment, and it discriminates against girls.

AB 1266, now codified as Education Code Section 221.5(f), violates two clear provisions of the California Constitution:

Section 28(f)(1) guarantees students the right to a safe school environment. That includes private, protected spaces for girls.
Section 31(a) prohibits gender discrimination. AB 1266 enables discrimination against girls by forcing them to compete against biological males and share intimate spaces with them.

Hilton added, “This isn’t complicated: California’s girls deserve fairness, safety, and privacy. The majority of Californians agree. Even Gavin Newsom agrees. But pathetically, he won’t fight to protect our girls. I will. One way or another, the injustice ends when I take office as governor.”
